Terms and Conditions of Sale:

1. General

In these conditions of sale:

The company means Olus Environmental Ltd, Company No: 1770276. Correspondence Address: Heritage Products, Winterpick Business Park, Hurstpierpoint, Wineham, Nr. Henfield W.Sussex BN5 9BJ The customer means any person contracting with the company for the supply of products or services. Delivery means delivery by the company or any subcontractor employed by the company directly or indirectly. These conditions may only be modified by a variation in writing signed on behalf of the company by a director. Completion and submission of a purchase order online will be taken as agreement to these conditions of sale.

2. Supply of Products

Products are sold under the express understanding that: Contracts for the supply of goods or services to retail or domestic customers are governed by The Sale of Goods Act 1979 (as amended) and supplied in compliance with, The Consumer Protection (distance selling) regulations 2000 as amended by S1689 2005. Any customers contacting in the course of their business are excluded from consumer protection legislation and are contacting with the company on a business to business basis.

The customer and the company are contracting in the course of their respective business and except as stated in writing by the company no condition or warranty is given or implied by law, custom, usage or otherwise as to the quality or fitness for any purpose of the goods sold by the company.

The customer understands and accepts that products sold by volume (i.e. compost / bark / mulch) are measured when packed and due to the nature of the product a degree of settlement will occur.

The company require any complaint to be made in writing by the customer within 48 hours of collection or delivery.

If the customer is dissatisfied with the product then it must be returned to the company within 5 working days after the complaint has been logged. A refund will then be made for the original purchase price.

All prices quoted by the company for the sale of products online include the cost of delivery within a 20km radius of our premises at Wineham near Henfield W.Sussex BN5 9BJ.

Customers are required to pay by credit or debit card at the time of ordering.

Prices quoted are all inclusive of VAT at the current rate. Delivery is normally within four working days unless stated at the time of order. All items shall be at the customers risk from the time of collection or from the time of delivery. After such time the company shall be under no liability for loss, damage or deterioration of items from whatever cause arising.

Product and service descriptions.

We have taken reasonable precautions to try to ensure that prices quoted on the Website are correct and that all products have been fairly described. However, when ordering products or services through the Website, please note that:

  • orders will only be accepted if there are no material errors in the description of the goods or services or their prices as advertised on this Website.
  • all prices are displayed in pounds Sterling inclusive of UK VAT where applicable unless expressly indicated otherwise.
  • packaging may vary from that shown on the Website.
  • the weights, dimensions and capacities shown on the Website are approximate only.
  • whilst we try to display the colours of our products accurately on the Website, the actual colours you see will depend on your monitor and we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.
  • all items are subject to availability.

We will inform you as soon as possible if the product(s) or service(s) you have ordered are not available and we may offer alternative product(s) or service(s) of equal or higher quality and value.

Acceptance of your order

Please note that completion of the online checkout process does not constitute our acceptance of your order. Our acceptance of your order will take place only when we dispatch the product(s) or commencement of the services that you ordered from us.

If you supplied us with your email address when entering your payment details (or if you have a registered account with us), we will notify you by email as soon as possible to confirm that we have received your order.

All products that you order through the Website will remain the property of Heritage Products until we have received payment in full from you for those products.

During the checkout process, you will be asked to complete your payment details. All fields indicated as compulsory must be completed. Please note that we will collect and store your information, using an encrypted secure payment mechanism and will only use your information in accordance with our Privacy Policy.

All card payments are subject to authorisation by your card issuer and we take payment when we accept your order shortly before dispatch. If your payment is not received and you have already received the products you ordered from us, you must pay for the products or return those products to us in accordance with reasonable return instructions that we provide to you and in the same condition that you received them at your own expense. If you do not do this within 30 days of the date on which we cancel your order, we may collect or arrange for collection of the products at your expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.

If we cannot supply you with the product or service you ordered, we will not process your order, inform you of this in writing (including e-mail) and, if you have already paid for the product or service, refund you in full as soon as reasonably possible.

3. Delivery

Delivery is normally within 4 working days. Working days are classed as Monday to Friday, excluding bank holidays.

Please note: for orders being delivered to the Isle of Wight please contact us directly for prices.

The company will make every effort to deliver products ordered on the agreed date, but, if for any reason the company is unable to deliver then no liability will fall to the company; whether in damages or otherwise, for delay of whole or any part of the goods ordered arising from any cause whatsoever.

Please read our delivery information page . If access is restricted e.g walls, steps, gravel etc please make this clear at point of ordering. Once a delivery has been dispatched and fails due to insufficient information given you will incur delivery charges per item. Delivery vehicles must be able to park adjacent to where the delivery is to be made and it is the customers responsibility to provide a suitable area free from access restrictions for the delivery to be left. It is the customer's responsibility to move the products from the place of delivery.

The company can only guarantee Kerbside Deliveries. It is your responsibility in some areas of the UK to obtain a permit from your local council to have bulk bags and loose loads left on the kerbside.

After a delivery has been made, the responsible for the security and insurance of the products lies with the customer.

Delivery by the company shall be conditional upon access free from encumbrances and good roads being available to the company's vehicles to the place of delivery. Deliveries are made using large vehicles and it is the customer's responsibility to inform the company if there may be an access problem or a certain method of delivery vehicle is required.

The company will not accept any liability for damages to property / driveways caused during delivery.

If the company or its agent cannot complete the delivery due to access problems, then additional costs may be incurred and shall ultimately fall to the customer. In such cases that delivery, in the opinion of the company is not possible, then the company reserves the right to cancel the order.

The customer, or somebody appointed by the customer, should be at the delivery point to accept the delivery.

The company reserves the right to cancel or hold any orders that the company deems may suffer from potential delivery problems and the customer understands that delivery dates may be delayed in these instances.

The company reserves the right to cancel or hold orders should ordered products be out of stock.

4. Collected Orders from the Company's Premises

The customer will comply with all requirements of Health & Safety Legislation. The wearing of appropriate PPE is mandatory.

The company accepts no responsibility for injury or damage caused to persons or equipment whilst on company premises.

5. Cancellation

The customer has the right to cancel any product or services, except for non stock items which have been purchased specially for a customer. Any cancellation must be at least 24 hours before delivery is due. Cancellations are accepted by telephone and by any of the following methods:

a. Electronic Mail to sales@heritage-products.co.uk

b. Fax to 01273 493088

c. Letter to Heritage Products, Winterpick Business Park, Hurspierpoint Road, Wineham Nr.Henfield W.Sussex BN5 9BJ. Letters will be have been deemed to be received two working days following the postmark date.

If you cancel your order after your products have been dispatched a refund will be credited to your account less already incurred delivery charges per item.

If you wish to cancel a bulk order (deliveries made loose, by tipper vehicle) after the delivery has already been made it will be your own responsibility to return the goods to Heritage Products premises at Wineham Nr. Henfield W.Sussex BN5 9BJ.

If you cancel your order within 7 working days of delivery, you will be issued a full refund once the goods have been returned to the company, at your cost, as per the Distance Selling Regulations.

6. Heritage Products and Customer agreement

I, the customer agree that I have read and fully understand all the terms and conditions above, I understand that once I click on the order button I will be liable for any delivery charges incurred if I then cancel the order, as well as any costs for redelivery of the goods to Heritage Products premises at Wineham Nr. Henfield W.Sussex BN5 9BJ.

I have viewed the pictures of the products I have ordered and understand the quantity that will be delivered. I also understand that all products that Heritage Products supplies are naturally occurring products and may have slight variations in colour, size and content shown on the website.

I understand that the delivery will be made by way of a 7.5 tonne vehicle or larger to my kerbside and understand it is up to me to transport goods thereafter.

I confirm there is enough room for access. I also understand that if there is any possibility of there not being access (in the delivery driver's view) I may be liable for a failed delivery/redelivering charge.

I understand for health and safety reasons that the tonne bags are non-returnable and can only be used once.

These conditions and any contract or variation are governed by the law of England. Any disputes arising from these conditions or any contract or variation entered into by the company with the customer which cannot be settled in the ordinary course of business shall be referred to a single arbitrator in accordance with the arbitration act 1950 or any modification thereof for the time being in force.
